ACCEPTABLE USE POLICY

Legal: Terms of Service Overview
Flight Level Servers provides services to people and businesses all over the world. As such, we have a responsibility to protect our clients and provide them with the best services available. The following guidelines were designed to insure this for our clients. Please review them carefully before ordering service.

Content:
All services provided by Flight Level Servers may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secrete and other statute. The subscriber agrees to indemnify and hold harmless Flight Level Servers from any claims resulting from the use of the service, which damages the subscriber or any other party. Note: Pornography and sex-related merchandising are prohibited on any Flight Level Servers server.  This includes sites that may infer sexual content, or link to adult content elsewhere. This is also true for sites that promote any illegal activity or content that may be damaging to flightlevelservers.com servers or any other server on the Internet. Links to such materials are also prohibited by Flight Level Servers. Flight Level Servers will be the sole arbiter as to what constitutes a violation of this provision, and reserves the right to deactivate and remove any site at any time for any reason without refund. Examples that constitute violation of our policy:

• Pirated content: software, movies, songs, videos, and other such material
• Pornography / Nudity / Adult Content
• Warez sites
• Bulk Email or Spam related products or activities
• Illegal material, or material that violates public policy or public laws>
• Illegal or Unauthorized Access to other Computers or Networks (causing mischief using Flight Level Servers servers, or towards Flight Level Servers servers)

System Resource Usage:
If the Flight Level Servers system administrator team determines that a user/client is exceeding the acceptable amount of system resources, be it bandwidth, disk space, processor capabilities, etc., Flight Level Servers reserves the right to temporarily or permanently deactivate the account that has caused the infraction. Refunds may or may not be issued depending on individual cases. Accounts using up enough resources to slow or crash the server will be promptly shutdown. Additionally, flat-file based message boards, such as Ultimate Bulletin Board (UBB), Ikonboard, or YaBB are strictly prohibited due to excessive resource drainage. The MySQL versions of these previously mentioned boards are acceptable. The final decision resides with the management of Flight Level Servers.

Excessive Bandwidth Use:
Each account comes with its own bandwidth limit. Flight Level Servers expects its users to comply with their Terms of Service, and not abuse bandwidth. If a client goes over the monthly limit, they agree to pay for that excess. Currently, Flight Level Servers charges $4.00 per gigabyte or leftover part of a gigabyte. If a client exceeds his bandwidth amount for the month, they agree to either: comply by Flight Level Servers's policy and pay for each gigabyte used, upgrade their account, or risk temporary suspension or termination of their account. Flight Level Servers reserves the right to make the final decisions.

Cancellation:
Cancellation can be made via email to support@flightlevelservers.com. Although no notice is required, and there is no cancellation fee, all fees paid for service up to the notice of cancellation are non-refundable. If cancellation is made within the first 30 days of service all hosting fees will be refunded. This does not include fees for domain registration.

Unsolicited E-Mail (spam):
Spamming, or the sending of unsolicited email, from a Flight Level Servers server or using an email address that is maintained on a Flight Level Servers machine is STRICTLY prohibited. Flight Level Servers will be the sole arbiter as to what constitutes a violation of this provision. Anyone caught spamming using a Flight Level Servers account will immediately have their account cancelled. Additionally, local law officials may be notified of your activites.

Changes to Terms of Service:
Flight Level Servers.com reserves the right to change the Terms of Service without notification. Any major changes to the Terms of Service will result in a notification to all current customers.

Suspension:
Activity which results in a suspension or deactivation of an account will result in a forfeiture of fees paid. Complaints made regarding abuses of an account will be grounds for suspension.

Refusal of Service:
 We reserve the right to refuse, cancel, or suspend service at our sole discretion. All sub-networks, distributive hosting sites, and dedicated servers of flightlevelservers.com must adhere to the above policies.
